ArcGIS for Power BI Terms of Use
IMPORTANT—READ CAREFULLY
These terms of use govern your use of ArcGIS for Power BI, unless you have a signed license agreement with Environmental Systems Research Institute, Inc. (“Esri”) that supersedes these terms of use. Esri may change the terms of use of ArcGIS for Power BI and will provide notice of such change by updating the terms of use published at https://www.esri.com/en-us/legal/terms/arcgis-maps-for-power-bi-terms-of-use. You are responsible for reviewing these terms of use from time to time and to remain compliant with any such changes. If you do not consent to these terms of use of ArcGIS for Power BI, please cease use immediately.
Esri grants to you a personal, revocable, nonexclusive, nontransferable right to use ArcGIS for Power BI for your business use solely in conjunction with your authorized use of Power BI. You may view, use, copy, reproduce, publish, publicly display, or redistribute map images derived from ArcGIS for Power BI in hard copy or static, electronic formats (e.g., PBIX, PDF, GIF, JPEG) if you retain the trademarks and attributions on the map image.
You may not (i) use ArcGIS for Power BI as a service bureau; (ii) reverse engineer, decompile or disassemble, ArcGIS for Power BI; (iii) manually or systematically collect or scrape data from ArcGIS for Power BI; (iv) benchmark the availability, performance, or functionality of ArcGIS for Power BI for competitive purposes; (v) probe, scan, or test the vulnerability of ArcGIS for Power BI or breach any security or authentication measures used by ArcGIS for Power BI; (vi) use ArcGIS for Power BI for real-time, dynamic routing purposes (e.g., turn-by-turn directions); or (vii) use or authorize others to use the data from ArcGIS for Power BI for direct marketing purposes, resale publication, or distribution to any third party as part of any mailing list, directory, classified advertising, or other compilation of information.
You do not receive title to or ownership of ArcGIS for Power BI, user documentation, Esri and its licensors’ data, or Esri trademarks hereunder. Additional data attribution requirements can be found at https://www.esri.com/legal/third-party-data. Esri and its licensors reserve all rights not expressly granted herein. You hereby grant Esri and its service providers a nonexclusive, nontransferable, worldwide right to host, run, and reproduce your data solely for the purpose of enabling your use of ArcGIS for Power BI. Without your permission, Esri will not access, use, or disclose your data except to comply with the law or any court or government order. You retain all right, title, and interest in your data. ArcGIS for Power BI is provided “AS IS” without any warranty of any kind. ArcGIS for Power BI is not designed, manufactured, or intended for use in environments or applications that may lead to death, personal injury, or physical property/environmental damage. Esri is not responsible for any damages, liabilities, or losses that may result from any (i) use of or (ii) interruption or suspension of ArcGIS for Power BI.
The failure of Esri to enforce any provision of these terms of use will not be deemed a waiver of the provisions or of the right of Esri thereafter to enforce that or any other provision. You agree that if any provision of these terms of use is held to be unenforceable for any reason, such provision will be reformed only to the extent necessary to make the intent of the language enforceable. You will not assign, sublicense, or transfer any rights or obligations under these terms of use and any attempt to do so without consent will be void. US federal law and the law of the State of California govern these terms of use, excluding their respective choice of law principles. These terms of use are not subject to the United Nations Convention on Contracts for the International Sale of Goods.
